These Terms and Conditions (“Terms”) govern your use of the ORMA web application, iOS application, and Android application (collectively, the “App”). The App is owned and operated by vDev, Inc. (“Company,” “we,” “us,” or “our”).

By accessing or using the App, you agree to these Terms. If you do not agree, you must not use the App.

1. Acceptance of Terms

1.1 By accessing or using the App, you agree to be bound by these Terms.

1.2 The App may include features powered by third-party services, including artificial intelligence tools such as Google Gemini. By using the App, you agree that your content may be processed by such services in accordance with their respective terms.

2. Definitions

2.1 “App” means the ORMA web, iOS, and Android applications.

2.2 “User” means any person who accesses or uses the App.

2.3 “Content” means any text, images, videos, audio, or other materials uploaded or shared through the App.

3. License to Use

3.1 The Company grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use.

3.2 You may not copy, distribute, modify, or create derivative works from the App.

4. User Content

4.1 You retain ownership of your Content.

4.2 By uploading Content, you grant the Company a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, display, and distribute such Content for operation, promotion, and improvement of the App.

4.3 You are solely responsible for your Content.

4.4 Data Loss and Deletion

Users are responsible for maintaining copies of their Content. The Company is not responsible for accidental or intentional deletion, loss, or corruption of Content. We may attempt recovery but do not guarantee it.

5. User Conduct

You agree not to:

Use the App for unlawful purposes
Upload harmful, offensive, or illegal content
Interfere with or disrupt the App
Attempt unauthorized access

6. Eligibility

6.1 You must be at least 13 years old to use the App.

6.2 The App is not intended for children under 13, and we do not knowingly collect data from them in compliance with the Children’s Online Privacy Protection Act (COPPA).

7. Data and Privacy

7.1 Your use of the App is also governed by our Privacy Policy.

7.2 Certain rights may apply depending on your state of residence.

8. Third-Party Services

8.1 The App may use third-party services, including hosting, analytics, and AI tools.

8.2 We are not responsible for the availability, accuracy, or practices of third-party services.

9. Service Availability

9.1 The App is provided on an “as available” basis.

9.2 We may modify, suspend, or discontinue any part of the App at any time without notice.

10. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

11. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for:

Loss of data or Content
Service interruptions
Indirect, incidental, or consequential damages

This includes loss resulting from deletion or system errors.

12. Account Suspension and Termination

We may suspend or terminate your account at any time for violations of these Terms or misuse of the App.

Upon termination, access to your data may be restricted or deleted.

13. Intellectual Property and Copyright

13.1 We respect intellectual property rights.

13.3 We may remove infringing content.

14. Indemnification

You agree to indemnify and hold harmless the Company from any claims arising from your use of the App.

15. Dispute Resolution

15.1 Any disputes shall be resolved through binding arbitration.

15.2 You waive the right to participate in class action lawsuits.

16. Governing Law

These Terms are governed by the laws of the State of New York.

17. Export Compliance

You agree to comply with all applicable U.S. export laws and regulations.

By providing your phone number, you consent to receive verification messages. Message and data rates may apply.

19. Changes to Terms

We may update these Terms at any time. Continued use of the App constitutes acceptance.
