These Terms and Conditions ("Terms") govern your use of the ORMA web application (the "Web App"). By accessing or using the Web App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Web App.

ORMA is a proprietary application owned and operated by vDev, Inc. These Terms and Conditions ("Terms") govern your use of the ORMA web application, iOS app, and Google Play app (collectively, the "App"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

Acceptance of Terms 

1.1. By accessing or using the App, you agree to these Terms in full. If you disagree with any part of these Terms, you must not use the App. 

1.2. By using our product, you are agreeing to Google Gemini terms and conditions. Please refer to Google Gemini Terms and Conditions.

Definitions 

2.1. "App" refers to the ORMA web application, iOS app, and Google Play app. 

2.2. "User" refers to any individual who accesses or uses the App.

 2.3. "Content" refers to any text, images, videos, or other materials uploaded, submitted, or transmitted by users through the App.

License to Use the App 

3.1. Subject to these Terms, vDev, Inc. grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. 

3.2. You agree not to distribute or make the App available over a network where it could be used by multiple devices at the same time.

Use of Cookies 

4.1. By using the App, you consent to the use of cookies in accordance with our Cookie Policy. Our Cookie Policy governs the use of cookies and tracking technologies on the App and is incorporated herein by reference. 

4.2. Cookies may be used to collect information about your usage patterns and preferences to enhance your experience on the App.

User Content 

5.1. By uploading, submitting, or transmitting any content through the App, including but not limited to pictures, you grant vDev, Inc. a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content for the purpose of promoting the App and related services, including advertisements.

 5.2. vDev, Inc. reserves the right to review, monitor, and remove any user-generated content that violates these Terms or is deemed inappropriate, offensive, or unlawful.

 5.3. Each user is responsible for the content they upload. vDev, Inc. is not responsible if any offensive messages are uploaded. We do not support any offensive content that gets posted.

Ownership of Content 

6.1. Users retain ownership of the content they upload or submit through the App but grant vDev, Inc. the rights specified in Section 5.1.

User Conduct

 7.1. You agree not to use the App for any unlawful or prohibited purpose or in any manner that could damage, disable, overburden, or impair the App. 

7.2. You agree not to post any content that contains nudity, sexual content, offensive material, or any other content that violates applicable laws or community standards. 

7.3. You agree to abide by all applicable laws and regulations regarding your use of the App and the content you upload or submit.

Eligibility 

8.1. You must be at least 13 years old to use the ORMA App. By using the App, you confirm that you meet this age requirement.

Data Collection and Storage 

9.1. vDev, Inc. collects and stores user sessions, including but not limited to IP addresses, device information, and usage statistics, to improve the functionality, security, and performance of the App. 

9.2. vDev, Inc. adheres to its Privacy Policy regarding the collection, use, and storage of user data. Please read the Privacy Policy for more information. 

9.3. User data collected by vDev, Inc. may be used for purposes such as user authentication, analytics, and personalization of content and advertisements.

Security 

10.1. vDev, Inc. employs reasonable security measures to protect user data and prevent unauthorized access, disclosure, alteration, or destruction. 

10.2. Users are responsible for maintaining the confidentiality of their account credentials and for any activity that occurs under their account.

Limitation of Liability 

11.1. To the fullest extent permitted by law, vDev, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the App.

Indemnification 

12.1. You agree to indemnify, defend, and hold harmless vDev, Inc. and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the App or any violation of these Terms.

Governing Law and Jurisdiction 

13.1. These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. 

13.2. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the State of New York.

Changes to Terms 

14.1. vDev, Inc. reserves the right to modify or replace these Terms at any time. If we make material changes, we will notify you by posting the new Terms on the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

Compliance with State Regulations 

15.1. vDev, Inc. abides by state regulations regarding user data and privacy, not limited to New York State.
